These terms govern your use of akaricollective.com (the "Site"), operated by Akari Collective LLC ("Akari Collective", "we", "us"). By using the Site you agree to them. If you do not agree, please do not use the Site.

What the Site is

The Site is an informational portfolio describing Akari Collective and the brands it operates. It does not sell products or services directly. Each brand's own website and social accounts are governed by their own terms and policies, which apply when you use them.

Using the Site

You may view, download, and print pages from the Site for personal, non-commercial use. You agree not to:

  • Use the Site in any way that breaks applicable law or infringes anyone's rights.
  • Attempt to gain unauthorised access to the Site, its hosting infrastructure, or any connected system.
  • Introduce malicious code, scrape the Site at a rate that degrades it, or interfere with its operation.
  • Reproduce, republish, or distribute Site content for commercial purposes without our written permission.

SMS program terms: Akari Collective Updates

These terms apply when you opt in to receive text messages from Akari Collective LLC("Akari Collective Updates").

  • What you'll receive. By opting in, you agree to receive occasional news from Akari Collective and its brands, such as launches, events, and openings, sent by Akari Collective LLC to the mobile number you provide.
  • How often. Message frequency varies, typically no more than 4 messages per month.
  • Cost. Message and data rates may apply. Check with your mobile carrier for details about your plan.
  • How to opt out. Reply STOP to any message at any time and you will be unsubscribed. You will receive one final message confirming you have opted out. You can also email hello@akaricollective.com.
  • How to get help. Reply HELP to any message, or email hello@akaricollective.com.
  • Consent. Consent to receive text messages is not a condition of any purchase or service. You must be at least 18 and the account holder or have the account holder's permission for the number you provide.
  • Carriers. Carriers are not liable for delayed or undelivered messages. Delivery depends on carrier network availability.
  • Your information. How we handle your mobile number and consent record is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
  • Changes. We may change or end the program at any time. If your mobile number changes, you are responsible for opting out from the old number and opting in again.

Intellectual property

Unless stated otherwise, the Site and its content, including text, graphics, logos, and brand names, are owned by Akari Collective LLC or its licensors and are protected by copyright, trademark, and other laws. "Akari Collective" and the names of our brands are trademarks or trade names of Akari Collective LLC. Nothing on the Site grants you a licence to use them.

Third-party links

The Site links to other websites and platforms, including our brands' sites and Instagram. We do not control those sites and are not responsible for their content, availability, or practices. A link is not an endorsement of a third party.

No warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.

Limitation of liability

To the fullest extent permitted by law, Akari Collective LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnity

You agree to indemnify and hold harmless Akari Collective LLC from any claims, losses, and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the Site.

Changes

We may change the Site or these terms at any time. The date at the top shows when the terms were last revised. Continued use of the Site after a change means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
